1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and FarBird Global LLP (“we,” “us,” or “our”), concerning your access to and use of our services and website.
2. Products and Orders
We act as a merchant exporter sourcing products from manufacturers in India. While we strive for accuracy, we do not warrant that product descriptions, colors, or other content is accurate, complete, reliable, current, or error-free. All orders are subject to acceptance and availability.
3. Pricing and Payment
All prices are quoted in USD unless otherwise stated. Prices are subject to change without notice due to currency fluctuations or market conditions. Payment terms (e.g., Letter of Credit, Advance TT) will be agreed upon in the specific Proforma Invoice/Contract.
4. Shipping and Delivery (Incoterms)
Unless otherwise agreed in writing, shipments are made under standard Incoterms (FOB, CIF, etc.) as defined in the specific sales contract. Risk of loss passes to the buyer upon delivery to the carrier or as per the agreed Incoterm.
5. Limitation of Liability
To the fullest extent permitted by law, FarBird Global LLP shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of or related to the use of our services or products.
6. Governing Law
These Terms shall be governed by and defined following the laws of India. FarBird Global LLP and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
